Why do you need these services?

Most compliance legislation requires an effective Compliance Programme to be implemented, depending on the nature of the business, but which should be assessed/audited on a regular basis, such as:

  • Money Laundering Regulations 2017, where businesses must conduct regular independent audits on their anti-money laundering controls and annual audits on their safeguarding policies and procedures.

  • The UK Bribery Act, anti-corruption legislation which requires all businesses to implement effective controls, procedures and processes, not only governing acts by employees, but also to any associated parties or agents, basically anyone who acts on the Company's behalf.

As penalties are high, it is critical that a business has a Compliance Programme in place, which is proportionate, risk based and regularly reviewed. Being able to demonstrate an adequate and effective Compliance Programme is key and would be the only defence and to reducing or avoiding penalties, should an incident occur.

Regulators are now asking for evidence that a programme is well designed, has been implemented effectively and works in practice. Part of being able to prove you have an effective compliance programme, is evaluating your risk profile periodically, conducting regular reviews and an external independent audit of the programme.

You may have no programme or a comprehensive programme implemented. Either way, to meet regulatory requirements, a cost effective audit of the business or existing Compliance Programme needs to be conducted. This provides the business with documentational evidence of the required independent review and provides details of where there may be gaps for continuous improvement.
